Quite frankly we would not have been able to secure our purchase without this incredible team, to say they went the extra mile is an understatement. Brookes Bliss handled our sale and purchase, Johnathan was open and upfront regarding the sale of our house, he secured a great price in under a few weeks. He was on the ball with a very complicated purchase and always responded to messages and passed on information promptly. The brochure photographs were amazing and really showed our house off to the best it could be, the photographer was very professional and took his time to get the right shots. The office staff were also great, in particular Lin who was always on hand if Johnathan was out of the office. All in all a fantastic team, we could not have wished for more.

When my tenancy came to an end in March, I was informed that I had to comply with clause 5.9 of the TA which stipulates that the tenant is “To take reasonable measures to ensure that the chimneys are kept clear and regularly swept. All chimneys must be professionally swept at the expiration of the tenancy at the tenant’s expense regardless of the frequency of use”.
I challenged this, directing Brooks Bliss to Section 11 of the Landlord and Tenant Act 1985 which states that the Landlord is legally responsible for ensuring the safety, working and servicing of all heating and hot water installations, including open fires, Rayburns, Agas, coal, wood burning stoves, all flues and ventilation therefore, under this Act it is the Landlord’s responsibility to have all chimneys swept.
Brookes Bliss legal team at ARLA Propertymark advised that clause 5.9 is standard within a TA and cannot understand why I feel this cannot be enforced. Brookes Bliss also advised that the TDS had confirmed to them that they were in the right therefore, they proceeded to arrange for the chimney cleaning to take place, deducting the fee from my Tenancy Deposit and then informed me that my landlord would be seeking to claim the cost.
The TDS Adjudicator's decision on the claim advised: “In terms of statute, Section 11 Landlord and Tenant Act 1985, the landlord is obliged to maintain all heating and hot water installations and this would include chimneys whether open or with a stove in place. As the statutory obligation for the landlord to maintain the chimney overrides that imposed on the tenant in the tenancy agreement, I am unable to make any award to the landlord.”
Brookes Bliss feel that the Section 11 Clause is rather subjective, considering they were advised by their legal team at ARLA Propertymark and another TDS adjudicator that the claim would be settled in favour of the Landlord.
It's a shame my money was deducted from my Tenancy Deposit and held for 16 weeks whilst we awaited a formal decision from the TDS Adjudicator, confirming that Section 11 superseded the TA, as it doesn’t leave you feeling great about the whole experience.
