Dishonest and unprofessional conduct “Accord Sales and Lettings”
I would strongly advise potential buyers to exercise extreme caution when dealing with Accord Sales and Lettings. My experience with them has been deeply unprofessional and, in my view, demonstrates a lack of integrity and transparency.
We had “an offer accepted” on a property. Following this, we acted in good faith, we proved our proof of funds (deposit) for AML checks, requested a second viewing as it was quite a long time since our first visit and hearing the acceptance of our offer, then paid the requested £60 fee, provided our solicitor’s details as requested, and began finalising our mortgage application based on the agreed offer.
Shortly after, the estate agent informed us that another offer had been received from another intersted party similar to our position. The communication from their team was contradictory and confusing. One agent, Gary, suggested the other party/buyer viewed during the week (assuming the week we requested our second viewing), while another agent, Sarah, claimed they (the other buyer) viewed before us. It was impossible to get a straight or consistent story !
We were told that the seller would make a decision on a "fair basis." In an effort to be cooperative and demonstrate our commitment, we increased our offer by a further a considerable amount that can make a difference between both parties (buyer) being similar position, assuming with the "similar offer" as we had no clear clue of the other party (buyer) being "similar position" to us, pushing our "already accepted offer" little further. We were given a deadline, which passed. Despite our good-faith increase, we were eventually told the seller had chosen to go with the other party.
When I questioned the logic of this, given we had an accepted offer, had paid fees, and had increased our bid, the responses from Gary were evasive and contradictory. At one point, he claimed that anyone can put in an offer until exchange of contracts, but when I asked if we could put in a further offer, he then stated they legally couldn’t accept it. The conversation was filled with illogical statements, and it was clear he was unable to justify the way we had been treated.
We were left asking who lacked due diligence here, as we had proceeded entirely in good faith based on their initial acceptance. Not only have we lost this property, but we also lost valuable time and other opportunities such as other offers that we let go while dealing with this agency.
It is disappointing to feel misled after being asked to pay fees and provide documentation in support of an accepted offer, only to have the rug pulled from under us with little explanation and inconsistent communication.
