We were looking to purchase a property that Warmingham's had listed for sale but withdrew after our Building Surveyor uncovered a significant structural defect known as roof spread and which was resulting in the exterior walls being pushed outwards by 120mm (out of plumb).
The vendor was onsite on the day of the inspection and when asked by our Surveyor if she knew of the roof issue she said that she did but under advice from Warminghams she got a structural report completed by an Engineer they have worked with for over 30 years and he had given the roof a clean bill of health. Following this we asked to see the report (which had been completed before the property was listed for sale but was never made mention of) and contrary to what we were told the report suggested additional strengthening works to the roof and also limiting the use of the roof going forward (so not a clean bill of health at all). Our Surveyor also pointed out that the Engineer's report completely failed to address the condition of the exterior walls that due to the level of movement as a result of the roof spread were also now structurally defective.
No mention of this was made by Warminghams during any our property various inspections or in any of the marketing and under the Consumer Protection Act 2008 it is actually illegal form them to have knowingly withheld this information (the concept of buyer beware no longer applies).
Had our Surveyor missed this then we could have proceeded with the purchase and then faced financial ruin as we would not have been able to afford the necessary works required to properly correct the problem. Even worse our building survey suggested that there was evidence to suggest that the roof spread was progressive and thus the roof was at risk of collapse if not attended to.
Considering this, and the fact that Warminghams did not disclose any of this information (nor would they have had our had our Surveyor not happened to speak directly with the Vendor) it was obviously their intention to conceal this issue and hope that prospective buyers would fail to identify it.
I almost find it chilling that during the process of the purchase I thought that we had built a good relationship with the Warminghams staff and all the while they knew of this issue and were comfortable with me potentially moving into this dangerous property with my wife and three young children unware of the risk the roof presented.
Their conduct was appalling and they should be ashamed of themselves. I was assured by the Managing Director after we pulled out of the purchase that future prospective purchasers would be provided with their Engineers roof report but given that the property was immediately relisted with exactly the same marketing (and no mention of the roof issue) and because of their conduct to date I have little faith that this will be the case....
