Mike Townsend acting as Arbitrator i.e. supposed to be independent. Didn't carry out a thorough conflict check. Didn't inform us when he did find out. Due to the conflict of interest eventually had to stand down. 7 emails and two letters cost £1006.20 inc VAT supposed to be paid by both sides. If he doesn't receive payment then he can refuse to stand down so the case can't carry on. Other side (his colleague's clients) haven't paid. Therefore we feel blackmailed to pay whole bill. I thought long and hard whether I should even leave a review, partly out of hypervigilance following the experience. To myself, it makes little difference in hindsight...I had a positive impression when I first appealed to Stags as a prospective tenant, viewed the property and payed half of the shorthold tenancy costs upfront, since references were scarce, being a relatively new tenant in the country, but finances were not. The property was everything I could have hoped for in my budget, the initial interactions with the staff were promising and professional, the presentation and package of support for maintenance, listed professionals, electricians etc suggested a high grade of security and there was every hope for a long term tenancy and feeling at home. Sadly, disputes arose with the 2nd tenant on the contract, regarding their financial responsibilities going unmet and regarding discipline in the house share, agreed upon adoption of additional pets beyond the declared ones, in lines with my own preferences as a legal tenant as well as approval by the agency. Disputes that wouldn't be in my ability or responsibility to resolve either. I was under the impression that a minimum of mediation and intervention was also part of the security an agency would offer, in contrast to a private landlord. I am now, in retrospective, aware of options and alternative dispute resolution but at the time I relied on Stags for assistance and such concerns. I consider it will have taken a minimum of concern and solidarity to avoid a lot of subsequent unpleasantness that I ended up feeling in my home at the time. I respected the property as much as I respected the cost to myself in the upfront rent and all the work behind it, to be able to live there, so the frequent arguments with the 2nd tenant over their financial responsibilities, histrionic responses, spontaneous adoption of pets and (lack of) concern for the property caused a great deal of distress, with no help from Stags in the matter... Bank statements underline both my commitment to a peaceful, orderly tenancy as well as my concerns, I hoped to see the same level of support from the agency as I have in the beginning, before committing to the tenancy. I am sadly left disappointed after a term of stress, unease and lack of support...I never imagined ending up having such problems with the housemate, millions of people live in houseshares all over the country, and a very difficult time could have been easily avoided if concerns raised were subject to a different approach/response, more communication, something. Worst case, I could have supported the remainder of the rent, in addition to what I already payed up front out of savings, given my employment and financial situation, but the erratic financial and domestic decisions of the 2nd tenant and suggestions of liability regardless of individual bank statements free of any room for interpretation put a great deal of pressure on me, in addition to verbal and other types of retaliation from the 2nd tenant past a certain point, being aware of my dialogues with the agency and lack of any meaningful intervention.. I'm very disappointed, and the traumatic experience reverberates still, due to the living conditions I hoped could be resolved by simple communication and clarification with the help of an agency, otherwise I will have taken the option of renting from a private landlord instead, which I will most likely do in the future, when there's more than a single tenant...... We were selling a high end one-of-a-kind contemporary waterside house. We are thankful that, after working for some time with another well-known estate agency, we engaged with Knight Frank’s Exeter office led by Mark Proctor in a Joint Agency engagement. Prior to moving from sole to joint agency we did a lot of thinking ourselves on who the buyer might be, where they might be, why they might buy the house, and how we might therefore redesign our marketing. We learnt from an advisor to this rethink that Mark had just come down to lead the Exeter office after a successful period in London. At about the same time, Mark called us as we had interviewed and not selected Knight Frank earlier in the process and we agreed to meet to explore ideas. We gradually realised that he brought a more assertive approach to the table and held out the possibility of reaching out to some of the audience that we were needing to target. When we first met Mark, he challenged us all on the content hosted on the websites, in the brochure, as well as the magazines and newspapers being used for the marketing campaign and the approach being taken in conducting show-arounds. We decided that his approach would add real value to us and employed him as a joint agent from this point. As a result of this open and transparent approach in which both agencies played a full role, we changed some of the images and some of the key messages. We made use of still aerial photography obtained from the drone video that we commissioned around this time which the first agent had recommended to us. And we agreed a revised approach to show arounds. Critically perhaps, during this rethink, Mark took part in a robust discussion involving all parties which saw us agree to reposition the house with a lower Guide Price; one that was aimed to be attractive to upselling to buyers primarily viewing properties in a lower priced category. Mark also made sure that "Flic" the home-viewer used by Knight Frank to show homes in South Hams, had the chance to spend a good amount of time at the house understanding its USPs. On being given the Joint Mandate, Mark and his team immediately made contact by phone with a number of clients to whom Knight Frank had shown houses in the same physical location and at prices below, sometimes well below, our revised Guide Price. It was a result of one of these calls that reawakened a family's interest in the village and its lifestyle potential and encouraged them to visit several properties marketed by different agencies on one day within a week of the Joint Agency being in place. Flic accompanied the family on their visit to our house. (FYI The buyer later expressed disappointment that at this price point the Knight Frank partner responsible had not deemed it worthwhile to conduct the show-around himself). At the end of these visits, our house was first included in the short list for debate overnight by the family and then selected as the preferred choice. . Mark discussed the matter with the other agency and they both recommended that we accept the offer which was on Guide Price.... Read more
